OVERVIEW
Under Hong Kong criminal law, a Drug Addiction Treatment Centre (DATC) Order is a custodial, rehabilitation-focused sentencing option governed by the Drug Addiction Treatment Centres Ordinance (Cap. 244).
A DATC order is imposed "in lieu" of a standard prison sentence for drug-dependent offenders who have committed minor drug offences or non-violent crimes fuelled by their addiction. It prioritizes cure, reformation and reintegration into society over punishment alone.
PRE-SENTENCE ASSESSMENT
DATC Suitability Report
A judge or magistrate cannot sentence a defendant directly to a DATC upon conviction. The court must first obtain a DATC Suitability Report.
Remand in custody pending suitability report
Under section 4(3) of Cap. 244, once a defendant is found guilty, the court may remand the defendant in the custody of the Commissioner of Correctional Services for up to three weeks so that the Correctional Services Department can compile the formal suitability report. Unlike community or probation orders, bail is rarely granted while a defendant is awaiting a DATC report.
The Correctional Services Department evaluates physical, personal and social factors to assess whether the offender is suitable for a structured rehabilitation environment:
- Addiction Stage: A government medical officer examines the defendant and assesses whether there is an actual physical or psychological drug dependency.
- Offence Profile: The offence must be suitable for a rehabilitative disposal. Serious offences, including high-volume commercial drug trafficking, will generally result in direct imprisonment rather than a DATC order.
- Social and Criminal History: The assessment considers matters such as criminal associations, family support, employment history and previous attempts at treatment or detoxification.
DETENTION AND SUPERVISION
Length of Detention
A DATC order does not have a fixed, predetermined length of time declared by the judge at sentencing. Under section 4(2) of Cap. 244, an inmate's stay can range from a minimum of two months to a maximum of 12 months.
The precise release date is determined through the Correctional Services Department's internal review process rather than being fixed by the sentencing judge. A Board of Review assesses the inmate regularly by reference to three principal considerations:
- Physical health recovery and response to psychological counselling.
- General conduct and progress within the centre's structured work programmes.
- The assessed likelihood of remaining drug-free after release into the community.
After discharge, every DATC inmate is subject to a mandatory 12-month statutory supervision period managed by a Correctional Services Department aftercare officer.
